A. TERMS AND CONDITIONS OF SALE OF PRODUCTS

 

Please read these conditions carefully before placing an order for any products offered on Shaadilogy.com for sale (the “Products”) by the registered sellers of Kaizen Webtech LLP (the “Seller”).This section deals with conditions relating to the sale of Products on the Website by the Sellers to the buyer of such Products from the Website (the “Buyer”) and the Buyer’s ("You" or "Your" or "Yourself" or "User") agreement to be bound by these conditions.

 

The Seller and the Buyer acknowledge, agree and understand that Kaizen Webtech LLP inter alia seeks to provide a platform (www.shaadilogy.com) wherein the Seller and Buyer can be brought together and Kaizen itself has no role in the execution or provision of sale or purchase, except for certain transaction support services such as facilitating the sale of goods through other e – commerce websites and payment.

 

  1. 1. Terms And Conditions Relating To The Sale Of Products To The Buyer

 

1.1.      This section deals with conditions relating to the sale of Products on the Website by Seller to You.

 

1.2.      Through the Website, Kaizen’s Sellers make available variety of Products for sale at an agreed price to You. Purchase of such Products will be subject to these Terms and Conditions of Sale and such other additional terms, if any, as specified by and agreed to between the Seller and/or Buyer inter alia the price of the Product, mode of delivery and time period of shipment, and the Terms of Use, Privacy Policy, Copyright Policy and Disclaimer of this Website.

 

1.3.      All the Products are governed by the terms of warranties provided by the respective Seller.

 

1.4.      The price of Products is either equal to or lesser than the Maximum Retail Price (the "MRP") i.e., the discounted rate prescribed for those Products. The MRP and other statutory declarations shall be mentioned on the Products and/or on its packaging in accordance with applicable laws.

 

1.5.      All commercial/contractual terms are offered by and agreed to between the Buyers and Sellers alone. The commercial/contractual terms include, without limitation the price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to Products and after sales services related to Products. Kaizen does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between Buyers and Sellers. It is agreed that the contract for sale of any of the Products shall be a strictly bipartite contract between the Seller and Buyer.

 

1.6.      Kaizen does not make any representation or warranty as to the specifics (such as quality, value, saleability, etc.) of the Products proposed to be sold or offered to be sold or purchased on the Website. Kaizen does not implicitly or explicitly support or endorse the sale or purchase of any Products on the Website. Kaizen accepts no liability for any errors or omissions, whether on behalf of itself or third parties.

 

1.7.      Kaizen is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers. Kaizen cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Website. Kaizen is not required to mediate or resolve any dispute or disagreement between Buyers and Sellers.

 

1.8.      Kaizen does not make any representation or warranty as to the item-specifics (such as legal title, creditworthiness, identity, etc.) of any user of the Website. You are advised to independently verify the bona fides of anyone that You choose to deal with on the Website and use Your best judgment in that behalf.

 

1.9.      Kaizen does not at any point of time during any transaction between You and Seller on the Website come into or take possession of any of the Products offered by Seller nor does it at any point gain title to or have any rights or claims over the Products offered by Seller to You.

 

1.10.   At no time shall Kaizen have any obligations or liabilities in respect of any contract entered into between Buyers and Sellers.

 

1.11.   The Website is only a platform that can be utilized by Buyers and Sellers to reach a larger base to inter alia buy and sell Products. Kaizen is only providing a platform for communication.

 

1.12.   You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance etc. with the Seller(s) that You transact with.

 

  1. 2. Sale Of Products

 

2.1.      The order placed by You is an offer to the Seller to buy the Product(s). When You place an order to purchase a Product from the Seller, You will receive an e-mail from Kaizen confirming receipt of Your order and containing the details of Your order (the "Sale Order Receipt E-mail"). The Sale Order Receipt E-mail is an acknowledgement that the Seller has received Your order, and does not confirm acceptance of Your offer to buy the Product(s) ordered. The Seller only accepts Your offer, and concludes the contract of sale for a Product ordered by You, when the Product is dispatched to You and an e-mail confirmation is sent to You that the Product has been dispatched to You (the "Sale Order Confirmation E-mail").

 

2.2.      Your contract is with the Seller, and You confirm that the Product(s) ordered by You are purchased for internal/ personal purpose and not for re-sale.

 

  1. 3. Pricing

 

3.1.      Prices for Products are as described on the Website and are incorporated into these Terms and Conditions of Sale by reference. Kaizen does not guarantee that the price of Products will be the lowest in the city, region or geography. All prices are in Indian rupees. Prices may change at Sellers discretion without notice or any consequential liability to You.

 

3.2.      Price, as displayed, is inclusive of all taxes at the appropriate rate. Products in Your shopping cart will always reflect the most recent price displayed on the Product detail page. Please note that this price may differ from the price shown for the Product when You first placed it in Your cart. Placing a Product in Your shopping cart does not reserve the price shown at that time. It is also possible that Product’s price may decrease/increase between the time You place it in Your shopping cart and the time You purchase it.

 

  1. 4. Shipping and Delivery

 

 

4.1.      Items are only delivered on business days. Apart from Sundays, there are certain holidays throughout the year that are not considered as business days. Deliveries will not happen on these days.  

 

4.2.      The charges for Shipping and Delivery of Products within India, would be borne by Kaizen, unless otherwise stated during the Checkout Process.

 

4.3.      Products can be shipped to international destinations. The shipping charges for international deliveries will be borne by You.

 

4.4.      Your shipping address, pin code will be verified with the database of Kaizen and the respective Seller before You proceed to pay for Your purchase. In the event Your order is not serviceable by the Seller or the area is not covered, Kaizen would request You to provide it with an alternate shipping address which Kaizen expects to have on the Seller’s delivery list.

 

 

  1. 5. Cancellation Policy 

 

5.1.      There may be certain orders that Kaizen and/or it’s Sellers are unable to accept and must cancel. Kaizen and/or it’s Sellers reserve the right, at their sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in Your order being cancelled include, without limitation, non-availability of the Product or quantities ordered by You, inaccuracies or errors in pricing information, fraudulent transactions etc. Kaizen will contact You if all or any portion of Your order is cancelled vide email (the “Sale Order Cancellation Confirmation Email”). If Your order is cancelled after You have been charged, the said amount will be reversed back in Your account. Kaizen will not be able to cancel orders that have already been approved and where a Sale Order Confirmation Email has been issued unless the situations envisaged in Clause 5.2 get actuated. You agree not to dispute the decision made by Kaizen and accept Kaizen’s decision regarding cancellation.

 

5.2.      The situations post Sale Order Confirmation Email where orders can be cancelled include but are not limited to;

 

5.2.1.  The price charged for a Product is refunded for any reason whatsoever; and

 

5.2.2.  Any other reason that Kaizen considers reasonable and justified.

 

5.3.      Any cancellation of an order whether by Kaizen and/or Sellers or You, in accordance with the Cancellation Policy, would make You eligible for refund of the amount charged.

 

  1. 6. Return and Exchange Policy

 

  1. A. Ready to Ship Products

 

  1. Timeline and Process for Return of Ready-to-Ship products:

 

Please contact Kaizen within twelve hours of delivery of the product by emailing support.store@shaadilogy.com with the subject line “Return Request”, clearly stating the reason for return in detail.

 

Possible reasons for return:

                            i.        Manufacturing defect

                          ii.        Product received is not what was ordered

                         iii.        Product received was damaged

 

If you are returning the product for any of the reasons specified above, Kaizen’s design team will inspect the product and if your claim is found to be valid, Kaizen will attempt to make arrangements to rectify the product or replace it with a new product. However, if your claim is valid and it is not possible to rectify or replace the product, Kaizen will issue a store credit equivalent in value to the selling price of the product, to be redeemed by you within six months from the date of issue on www.shaadilogy.com. The store credit will expire after six months from the date of issue.

 

Kaizen can only consider return requests

  • In cases where an email notification to this effect is sent by the buyer within twelve hours of delivery of the product
  • For products that are returned in an unused, unwashed state with all the tags and packaging intact

Kaizen will arrange for the product to be picked up from your address, and delivered to Kaizen’s office for inspection and further action (if any).

 

 

  1. Exchange Policy for Ready-to-Ship products

 

Although Kaizen cannot provide refund against any sold products, we may accept return of sold product by way of store credit of a value equivalent to the selling price of the product.

 

In case you wish to return a Ready-to-Ship product for any reason other than i, ii and iii above, a store credit equivalent to the selling price would be issued to you which can be redeemed on shaadilogy.com within a period of six months from the date of issuance of the store credit. The store credit will expire six months after the date of issue.

 

  1. B. Made-To-Measure and Made-To-Order Products

 

  1. Timeline, Process and Validity of Return Requests

 

Products that are Made-to-Order or customized (Made-to-Measure) cannot be returned for any reason other than:

 

1.1.      Manufacturing defect

1.2.      Product received is not what was ordered

1.3.      Product received was damaged

 

 

Kaizen can only consider return requests

  • In cases where an email notification to this effect is sent by the buyer within twelve hours of delivery of the product. Please email support.store@shaadilogy.com with the subject line “Return Request”, clearly stating the reason for return in detail.

 

  • For products that are returned in an unused, unwashed state with all the tags and packaging intact

Kaizen will arrange for the product to be picked up from your address, and delivered to Kaizen’s office for inspection and further action (if any). Return requests will only be entertained if Kaizen, at its sole discretion, finds the buyer’s claim to be valid.

 

  1. Exchange Policy for Made-to-Measure and Made-to-Order Products:

For Made-to-Order and Made-to-Measure products, exchanges are not possible. If Kaizen, at its sole discretion, finds the buyer’s return request to be valid, and is unable rectify or replace the product, Kaizen will issue a store credit equivalent in value to the selling price of the product to be redeemed by the buyer on Shaadilogy.com within six months from the date of issue.

 

Note: Return and/or exchange is not possible for Ritual Items and certain handmade Cosmetics, or if stated in the detailed description of the Product.

 

B. TERMS AND CONDITIONS FOR FACILITATING THE PURCHASE OF GOODS THROUGH E – COMMERCE WEBSITES

 

Please read these conditions carefully before buying any product offered on the Website for sale (the “Products”) through various affiliated e – commerce websites (the “Merchant”).This section deals with conditions relating to the sale of Products displayed on the Website and being purchased by the buyer from the Merchant’s website (the “Buyer”) and the Buyer’s ("You" or "Your" or "Yourself" or "User") agreement to be bound by these conditions.

 

The Merchant and the Buyer acknowledge, agree and understand that Kaizen Webtech LLP inter alia seeks to provide a platform www.shaadilogy.com to facilitate the sale of products through the Merchant’s website by connecting Buyers to Merchants and Kaizen itself has no role in the execution or provision of sale or purchase.

 

  1. Terms and Conditions relating to the sale of Products to the Buyer

 

1.1        This section deals with conditions relating to the sale of Products on the Website to Buyers through Merchants.

 

1.2        Through the Website, Kaizen displays a variety of Products which are offered on various Merchants websites for sale and redirects Buyers to the Merchant’s website to allow Buyers to purchase the Product.

 

1.3        Purchase of such Products will be subject to the Terms and Conditions for Facilitating the Purchase of Goods through E-Commerce Websites and such other additional terms, if any, as specified by Merchants on their websites and the Terms of Use, Privacy Policy, Copyright Policy and Disclaimer of this Website.

 

1.4        It is agreed that the contract for sale of any of the Products shall be a strictly bipartite contract between the Buyers and the Merchant/its seller.

 

1.5        Kaizen does not make any representation or warranty as to the specifics (such as quality, value, saleability, etc.) of the Products proposed to be sold or offered to be sold through the Website. Kaizen accepts no liability for any errors or omissions, whether on behalf of itself or Merchants or third parties.

 

1.6        Kaizen is not responsible for any non-performance or breach of any contract entered into between You and Merchants. Kaizen cannot and does not guarantee that the concerned Buyers and/or Merchants will perform any transaction. Kaizen is not required to mediate or resolve any dispute or disagreement between You and Merchants.

 

1.7        At no time shall Kaizen have any obligations or liabilities in respect of such contract entered into between You and Merchants.

 

 

 

C. TERMS AND CONDITIONS OF OFFERING SERVICES THROUGH LISTING

 

Please read these conditions carefully before contacting any registered service provider listed on the Website for availing the services provided by such service provider (the “Service Provider”).This section deals with conditions relating to any person contacting any Service Provider listed on the Websitethrough the information received from the Website (the “Customer”) and availing the Service Provider’s services and the Customer’s("You"or "Your" or "Yourself" or"User") agreement to be bound by these conditions.

 

The Customers and Service Providers acknowledge, agree and understand that Kaizen Webtech LLP inter alia seeks to provide a platform www.shaadilogy.com wherein the Customer and Service Provider can be brought together and Kaizen itself has no role apart from listing Service Providers on their Website and enabling Customers to view the information regarding the Service Providers. Kaizen itself has no role in the execution or provision of any professional service.

 

  1. Offer of Professional Services

 

1.1.      This section deals with conditions relating to the offer of services to Customers by the Service Providers through listing on the Website.

 

1.2.      Kaizen’s services are strictly limited to listing the Service Providers and their respective services on the Website along with relevant details regarding the Service Provider for the Customer’s to view.

 

1.3.      Availing of services provided by the Service Providers will be subject to the Terms and Conditions of Offering Services Through Listing and such other additional terms, if any, agreed upon and between You and the Service Provider and the Terms of Use, Privacy Policy, Copyright Policy and Disclaimer of this Website.

 

1.4.      All the services are governed by the terms of warranties provided by the respective Service Provider.

 

1.5.      All commercial/contractual terms including, without limitation, the service charges, payment methods, payment terms, warranties related to services shall be governed by such terms as agreed upon by and between You and the Service Provider. Kaizen does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between You and Service Providers. It is agreed that the contract for providing services shall be a strictly bipartite contract between You and Service Providers. Kaizen has not negotiated or discussed any terms of engagement with the Service Providers.

 

1.6.      Kaizen does not make any representation or warranty as to the specifics (such as quality, value, saleability, etc.) of the services proposed to be provided or offered to be provided on the Website. You must satisfy Yourself about all relevant aspects prior to agreeing to the terms of service with the Service Provider. Kaizen accepts no liability for any errors or omissions, whether on behalf of itself or Service Providers or third parties.

 

1.7.      Kaizen is not responsible for any non-performance or breach of any contract entered into between You and Service Providers. Kaizen cannot and does not guarantee that the concerned Service Provider will perform any transaction. Kaizen is not required to mediate or resolve any dispute or disagreement between You and Service Providers.

 

1.8.      At no time shall Kaizen have any obligations or liabilities in respect of such contract entered into between You and Merchants.

 

1.9.      You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance etc. with the Merchant(s) that You transact with.

 

 

(WHETHER IN CONTRACT; WARRANTY; TORT; DELICT (INCLUDING NEGLIGENCE; PRODUCT LIABILITY; ANY TYPE OF CIVIL RESPONSIBILITY OR OTHER THEORY) OR OTHERWISE)
